Commercial disputes

• An Asian State-owned construction company, Claimant in an ICC arbitration against its African joint venture partners and the joint venture. The dispute arises under a shareholders’ agreement and involves issues of abuse of right, res judicata, anti-suit injunctions and parallel proceedings. The law of the Respondents’ State applies.
• A Middle Eastern businessman in an ICC arbitration in Geneva related to the dissolution of a long-standing family partnership. The law of a Gulf State applied. Billions of dollars were at stake.
• Latin American investment companies in proceedings to seek the revision of an ICC arbitral award based on the Claimants’ allegations that the Respondents committed procedural fraud in the course of the arbitration. The arbitration, brought against a major European telecommunications company, related to the breach of a settlement agreement that was previously entered into by the parties in relation to multiple claims brought in several litigation proceedings. Brazilian law applied. Over USD 15 billion was at stake.
• A European life sciences company, Respondent in an arbitration brought by a European chemical company seeking indemnification under a Share Purchase Agreement. The law of the Claimant’s State applied. The arbitral tribunal dismissed the claims in their entirety and ordered the Claimant to reimburse all our client’s legal fees and costs.

Investment disputes

• The Republic of Colombia in the proceedings initiated by Angel Samuel Seda and others before an ICSID Ad hoc Committee to seek the annulment of the award rendered in ICSID Case No. ARB/19/6. The dispute arose from allegations of expropriation of a real estate project seized in application of Colombia’s asset forfeiture law and claims in excess of USD 300 million were brought under the 2012 Colombia-U.S. Trade Promotion Agreement. In a landmark award, the Tribunal dismissed all claims, finding that the essential security clause in the Agreement invoked by Colombia applied and protected Colombia’s measures designed to fight narcotraffic and money laundering.
• Chinese telecoms giant Huawei Technologies Co., Ltd. in an ICSID arbitration against the Kingdom of Sweden in relation to a number of measures taken by the Swedish authorities directly targeting Huawei’s investments in Sweden and excluding Huawei from the roll-out of 5G network products and services in the country.
• Georgia, Respondent in an SCC arbitration initiated by Mr. Zaza Okuashvili under the Georgia-U.K. bilateral investment treaty. The dispute relates to taxes owed to the State by various companies owned by the Claimant.
• The People’s Democratic Republic of Algeria, Respondent in an ICSID arbitration initiated by Société des Parcs d’Alger and Emirates International Investment Company LLC (ICSID Case No. ARB/18/11). The dispute arose from a contract for a large urban development project in Algiers. Over USD 2.5 billion was at stake.
• Cairn Energy PLC in an UNCITRAL arbitration against the Republic of India. The claims were brought under the U.K.-India bilateral investment treaty. The dispute related to retrospective tax measures adopted by the Indian Government. The tribunal ruled unanimously that India had breached its obligations to Cairn under the Treaty and awarded to Cairn damages of USD 1.2 billion plus interest and costs.
• The Arab Republic of Egypt, Respondent in an ICSID arbitration brought by Tantalum International, Ltd. and Emerge Gaming, Ltd. (ICSID Case No. ARB/18/22). The dispute arose from a mining enterprise and the claims were brought under the Egypt-Australia bilateral investment treaty.
• The Republic of Croatia, Respondent in an ICSID arbitration initiated by Georg Gavrilović and Gavrilović d.o.o. under the Croatia-Austria bilateral investment treaty (ICSID Case No. ARB/12/39). The dispute related to a food products enterprise.

Setting aside proceedings

• Georgia in proceedings initiated before the Svea Court of Appeal to request a declaration that a SCC-tribunal lacked jurisdiction in a case brought against the State by Mr. Zaza Okuashvili. The underlying dispute, which was brought under the Georgia-U.K. bilateral investment treaty, related to taxes owed to the State by various companies owned by Mr. Okuashvili.
• Latin American investment companies in proceedings initiated before the Paris Court of Appeal to seek the setting aside of two ICC arbitral awards rendered in two arbitrations brought against a major European telecommunications company, related to the breach of a settlement agreement that was previously entered into by the parties in relation to multiple claims brought in several litigation proceedings. Brazilian law applied. Over USD 15 billion was at stake. On 2 May 2024, the Paris Court of Appeal issued a decision setting aside the award rendered in the first arbitration on the ground that the President of the arbitral tribunal lacked the required independence. The decision was upheld by the Cour de cassation on 21 January 2026. The second annulment proceedings are still pending.
